Please read these Terms carefully. By accessing this website, registering for an event or making a donation, you agree to be bound by them. If you do not agree, please do not use this website.
1. About us
This website is operated by Hong Kong Community & Construction Association Charitable Foundation Limited ("HKCCA", "we", "us"), a charitable organisation established in Hong Kong.
2. Definitions
• "Platform" means this website and any associated registration or donation pages.
• "Event" means any activity, programme, course, workshop, visit or volunteer opportunity offered by HKCCA through the Platform.
• "User", "you" means any person accessing the Platform, registering for an Event or making a donation.
3. Eligibility
3.1 You must be at least 18 years old to register an account, submit a registration or make a donation on your own behalf.
3.2 A person under 18 may participate in an Event only where the registration is submitted by, or with the express consent of, a parent or legal guardian. By registering a person under 18, you confirm that you are that person’s parent or legal guardian, or that you have obtained their consent, and you accept these Terms on that person’s behalf.
3.3 Certain Events may impose additional requirements as to age, physical fitness, school affiliation or residency. These are stated on the Event page and are binding.
4. Registration and accounts
4.1 You agree to provide accurate, current and complete information and to keep it up to date. We may refuse, suspend or cancel a registration where information given is false, incomplete or misleading.
4.2 You are responsible for keeping any account password confidential and for all activity under your account. Notify us immediately at info@hkcca.com.hk if you suspect unauthorised use.
4.3 Registration is not confirmed until you receive a confirmation email from us. Places are limited and allocated on a first-come, first-served basis. Submitting a registration does not guarantee a place.
4.4 We may cancel a registration where a User has previously failed to attend a booked Event without notice, or has breached these Terms.
5. Fees, donations and payment
5.1 All amounts are stated and charged in Hong Kong dollars unless otherwise indicated.
5.2 Payments are processed by Payment Asia. Your use of that service is also subject to its own terms. HKCCA does not receive or store your full card or e-wallet credentials.
5.3 We reserve the right to correct any pricing error. Where a fee has been displayed incorrectly, we will contact you and you may confirm at the corrected amount or cancel for a full refund.
5.4 Donations made through the Platform are voluntary and are applied to HKCCA’s charitable purposes. Unless you have selected a specific appeal, donations are applied at HKCCA’s discretion to the area of greatest need. Where an appeal is over-subscribed or discontinued, we may apply surplus funds to a comparable purpose.
5.5 HKCCA is a charitable institution exempt from tax under Section 88 of the Inland Revenue Ordinance (IR File No. [91/17744]). Receipts for tax purposes are issued for donations of HK$100 or above.
6. Cancellations and refunds
Cancellations and refunds are governed by the HKCCA Refund and Cancellation Policy, which forms part of these Terms. In summary: event fees may be refundable depending on how far in advance you cancel; donations are not refundable once processed, except in cases of duplicate charge, error or unauthorised payment.
7. Participation, health and safety
7.1 Some Events take place outdoors, on construction or work sites, or involve physical activity. You must not participate if you are unwell, or if you have a medical condition that makes participation unsafe.
7.2 You must disclose at registration any medical condition, allergy, dietary requirement or accessibility need relevant to your safe participation. We may decline participation where we reasonably consider that we cannot accommodate a requirement safely.
7.3 You must follow all instructions given by HKCCA staff, volunteers, ambassadors and venue operators, and must wear any protective equipment provided. We may remove from an Event any person whose conduct is unsafe, disruptive, abusive or discriminatory, without refund.
7.4 You participate at your own risk. To the extent permitted by law, HKCCA is not liable for personal injury, illness, or loss of or damage to personal property arising during an Event, except where caused by our negligence.
7.5 HKCCA maintains public liability insurance for its Events. Participants are advised to arrange their own personal accident and travel insurance as appropriate.
8. Photography, filming and publicity
8.1 HKCCA may photograph, film or record its Events for reporting, funding acknowledgement, education and promotional purposes, including use on our website, social media, publications and submissions to funders.
8.2 By attending an Event you consent to such use. If you or a participant under your care do not wish to appear, please inform staff on site before the Event begins, or write to info@hkcca.com.hk, and we will take reasonable steps to accommodate the request. We cannot guarantee removal from material already published.
8.3 Participants may take personal photographs at Events, but must not photograph other participants without their consent, and must not use images in a way that is commercial, misleading or damaging to HKCCA or other participants.
9. Personal data
9.1 Personal data collected through the Platform is handled in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and our Privacy Policy .
9.2 We use your data to process registrations and donations, communicate about Events, issue receipts, meet funder reporting and audit requirements, and — where you have agreed — send you news about our work. You may withdraw consent to marketing communications at any time by writing to info@hkcca.com.hk.
9.3 Data may be shared with Event venues, co-organisers, funding bodies and service providers where necessary for the purposes above, and may be retained for as long as required for accounting, audit and funder reporting obligations.
9.4 You have the right to request access to, and correction of, your personal data. Requests should be sent to info@hkcca.com.hk.
10. Intellectual property
10.1 All content on the Platform, including text, graphics, logos, photographs, videos and teaching materials, is owned by or licensed to HKCCA and is protected by copyright and trade mark law.
10.2 You may view, download and print content for personal, non-commercial and educational use, provided you do not remove any copyright notice. Any other use — including reproduction, distribution, modification or commercial exploitation — requires our prior written consent.
10.3 If you submit content to us (for example photographs, comments or written feedback), you grant HKCCA a non-exclusive, royalty-free licence to use it for the purposes described in clause 8, and you confirm that you own the content or have the right to grant that licence.
11. Acceptable use
You must not use the Platform to: transmit unlawful, defamatory, harassing or obscene material; impersonate another person; introduce viruses or malicious code; attempt to gain unauthorised access to any part of the Platform or its systems; use automated means to extract data; or interfere with the operation of the Platform. We may suspend or terminate access for breach of this clause and report suspected offences to the authorities.
12. Availability and third-party links
12.1 The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, secure or error-free, and we may suspend, withdraw or restrict any part of it without notice.
12.2 The Platform may contain links to third-party websites. Those links are provided for convenience only; we do not control and are not responsible for their content, practices or privacy standards.
13. Limitation of liability
13.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under Hong Kong law.
13.2 Subject to clause 13.1, HKCCA shall not be liable for any indirect, special or consequential loss, or for loss of profit, opportunity, data or goodwill, however arising.
13.3 Subject to clause 13.1, HKCCA’s total liability to you in connection with an Event or a transaction on the Platform shall not exceed the amount you paid for that Event or transaction.
14. Indemnity
You agree to indemnify HKCCA against any claim, loss or expense arising from your breach of these Terms, your misuse of the Platform, or your conduct at an Event.
15. Force majeure
HKCCA is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including adverse weather, natural disaster, epidemic or public health measures, government order, civil disturbance, venue closure, or failure of power, network or payment systems.
16. Changes to these Terms
We may amend these Terms at any time. The amended version takes effect when published on the Platform. Your continued use after publication constitutes acceptance. The Terms applying to a registration or donation are those in force at the time it was submitted.
17. General
17.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
17.2 Our failure to enforce any provision is not a waiver of it.
17.3 A person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Ordinance (Cap. 623).
18. Governing law and jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region. You and HKCCA submit to the non-exclusive jurisdiction of the Hong Kong courts.
19. Language
These Terms are published in English and Traditional Chinese. In the event of any inconsistency between the two versions, the English version shall prevail.
